Privacy Policy Electronic Exchange Systems.
EXS We are committed to the safety of your personal,
company, and financial information. What kinds of personal, company
and financial information do we collect?
We request personal information about merchants (if they are sole
proprietorships and partnerships) and about the principals of merchants
(if they are otherwise formed as a legal entity) as part of the application
process to assist merchants in obtaining credit card and debit card
processing capabilities. Independent sales agents must also submit
personal and financial information as part of their application to
provide services for us. In all situations, the information requested
is necessary for us to evaluate all applications (whether for prospective
agents or merchants), to satisfy the legal obligations of our processing
partners and affiliates, to facilitate our ability to provide our
services, and to facilitate our ability to provide information about
our services and company. It may be used for, but is not limited to,
such activities as: administration of records; execution of accounting
and funding; and/or compliance with laws or regulations.
How is my information collected and transmitted?
All of your personal, company, and financial information, if provided
on-line, is collected via SSL secured and encrypted methods. As you
enter information into the data collection fields the information
is kept on your local machine. When you use the "submit button,
or similar feature, your data is transmitted across the Internet,
via the same SSL secured connection, to our servers. When you fax
your materials to us, we take measures to safeguard those materials
as well by limiting that information to private, secure fax servers
which are not in public areas of our offices and securely storing
the data.
How is my information stored and used?
When your data is submitted to us it is stored in our secure database.
The information that we collect is used to approve or update your
account. Many of our documents, once created, are made available to
you as Adobe Acrobat PDF files so that you may print them, sign them,
and return them to us either by mail or fax.
Personal data that is included as part of an application is utilized
to determine if underwriting and program requirements are satisfied,
and to ascertain if the applicant would satisfy the standards of the
various credit card associations, state and/or Federal governments.
Who is given or has access to my information?
Persons and companies directly involved in the setup of your merchant
account, or the approval of an application of a prospective independent
sales agent, will have access to or are given the information you
have provided. It is important to understand that these third-parties
are neither owned, nor operated, nor controlled by us and our affiliates.
We will also share data with our affiliates.
No information regarding specific persons will be provided to any
other third party except:
* to obtain commercial and credit information to establish, maintain
or renew accounts and contract(s),
* as may be required to provide any of the services for which a customer
has subscribed,
* as may be legally permitted,
* to assist in preventing or prosecuting fraud, or to otherwise comply
with a requirement or request of the government,
* to comply with the rules and regulations of any credit or debit
card payment network, or
* with the persons written consent.
This policy does not preclude our unrestricted use of non-personal,
summarized, derived, or aggregate information (i.e., volumes, totals,
averages, etc.). In addition, we may provide information, from time
to time, and as allowed by our customers respective contracts,
to provide personal information to entities that may have products
or services that may be of interest to them.
Customer Responsibility
As our agent or merchant you may be provided with a unique identifier
such as a merchant number, password, or PIN (personal
identification number) which is intended to authenticate your identity
when accessing our systems. Such identifying items are intended to
be secret and to be known, possessed, and used only by you. The effectiveness
of these mechanisms for authenticating your identity is dependent
upon you keeping them in your exclusive possession and upon you protecting
them from the discovery, access, or possession of others. If you fail
to keep such identifying information in your exclusive possession
(i.e., you allow others to have knowledge or possession of your merchant
number, password or PIN), you may bear responsibility for the actions
of other persons who use this information in accessing our systems.
Should you become aware or have reason to suspect that a personal
identifier has been lost or has been disclosed to someone other than
yourself, you should immediately notify us.
In the event of a data breach
We endeavor to utilize all reasonable methods to insure that private
data is only made available to those employees and third-parties on
a need-to-know basis. Should we ever be advised that the
security of your data has been breached and that you are at considerable
risk for identify theft; we will endeavor to notify you by email of
the nature of the data breach. In those circumstances, it would be
advisable for you to immediately notify the credit reporting agencies
of the data breach and to request that they issue a fraud alert on
your behalf.
Changes to Our Privacy Statement
In order that our information security and privacy policies are appropriate
and effective and that these policies reflect the ongoing changes
in our industry, we will review its policies and practices from time
to time and may make changes to these policies and practices as it
determines them to be warranted. When changes are made that affect
this Privacy Statement, this web site will reflect such changes.
